1. What games are available in GameHaven?

All games are free to play with generous daily content limits. Premium subscribers unlock unlimited access to all content, including fresh AI-generated puzzles and questions.
2. Is GameHaven free to play?
Yes. GameHaven is free to download and play. Free users get access to all 10 games with the following limits:
Trivia: 200 questions from the base pool
Rocket Blast Off: 100 words from the base word bank
Word Search: 5 puzzles per day
Crossword: 5 puzzles per day
Memory Match: Unlimited

4. How do I subscribe to Premium?
Open the app → go to the Profile tab → tap the Premium section. You'll see the available subscription options. Tap your preferred plan to subscribe. Payment is processed through your Apple ID.
5. How do I restore my purchases?
Go to Profile → tap the Premium section → tap "Restore Purchases" on the paywall screen. Your subscription will be restored automatically if you have an active subscription linked to your Apple ID.
6. How do I cancel my subscription?
Go to Profile → tap "Manage" next to your Premium status. This opens your Apple subscription settings where you can cancel or change your plan. You will retain Premium access until the end of your current billing period.
Alternatively: Open the Settings app on your device → tap your name → Subscriptions → GameHaven → Cancel Subscription.
Important: Deleting the app does NOT cancel your subscription. You must cancel through Apple's subscription settings.
7. Will I get a refund if I cancel?
Subscription refunds are handled by Apple. To request a refund, visit https://reportaproblem.apple.com, sign in with your Apple ID, and follow the instructions. GameHaven does not process refunds directly.
8. Can I change the game difficulty?
Yes. When starting most games, you'll see a difficulty selection screen where you can choose Easy, Medium, or Hard. The exception is Daily Challenges, which have a fixed difficulty set for all players.
9. How do Daily Challenges work?
Every day, a new challenge is available for each game. All players receive the same challenge with a fixed difficulty. Daily Challenges are free for all users and do not count toward your free-tier content limits. Complete all daily challenges for bonus coins.
10. How do I earn coins?
You earn coins by playing games and winning matches. Premium subscribers earn 2x coins on all activities. Coins can be spent in the Shop to unlock avatars, themes, and other cosmetic items.
11. Why can't I access the Shop?
The Shop is a Premium-only feature. Free users can still earn coins, but browsing and purchasing shop items requires an active Premium subscription. Upgrade from the Profile tab to unlock the Shop.
12. Why can't I access Multiplayer or Tournaments?
Multiplayer features — including Pass & Play, Online matches, WiFi games, and Tournaments — are available exclusively to Premium subscribers. Upgrade from the Profile tab or any premium prompt to unlock multiplayer.
13. Why can't I see the Leaderboard?
The Leaderboard is a Premium-only feature. Free users see a prompt to upgrade. Subscribe to Premium to view global and game-specific leaderboards.
14. Why can't I see Advanced Stats?
Detailed game statistics on the Profile page require Premium. Free users can see basic totals (games played, wins). Upgrade to Premium to view advanced breakdowns, win rates, streaks, and per-game analytics.
15. Why am I seeing content limits?
Free users have daily/lifetime limits on certain content:
Trivia: 200 lifetime questions from the base pool
Rocket Blast Off: 100 lifetime words from the base bank
Word Search: 5 puzzles per day (resets at midnight)
Crossword: 5 puzzles per day (resets at midnight)
When you reach your limit, you'll see a prompt to upgrade. Premium subscribers get unlimited access to all content, including fresh AI-generated puzzles and questions.
16. How does cloud sync work?
Sign in with Apple to enable cloud sync. Your game progress, stats, purchases, and saved games sync automatically across all your devices. You can also tap the cloud sync button on your Profile to manually trigger a sync.
17. Can I play offline?
Yes. All single-player games work fully offline. Your progress saves locally and syncs to the cloud when you're back online. Online multiplayer, tournaments, and leaderboards require an internet connection.
18. How do I sign in?
Go to Profile → tap "Sign In with Apple." This links your game data to your Apple ID for cloud sync, multiplayer, and leaderboard access. We only receive your name (if you choose to share it) and a unique identifier — we never see your Apple ID email or password.
19. How do I delete my account?
Go to Profile → Account → Delete Account. This permanently removes all your data, including game stats, match history, friends, saved progress, and cloud data. This action cannot be undone.
Important: Deleting your account does NOT cancel your Apple subscription. Cancel your subscription separately via Settings → Subscriptions on your device.
20. How do I manage notifications?
Go to Profile → Preferences → Notifications to customize which notifications you receive. You can also manage notifications in your device Settings → Notifications → GameHaven.
TROUBLESHOOTING
T1. The app won't open or crashes on launch.
Make sure you're running the latest version of GameHaven from the App Store.
Restart your device.
If the issue persists, delete and reinstall the app. Your data will be restored if you were signed in with Apple.
T2. I subscribed but Premium features aren't unlocking.
Tap Profile → Premium section → "Restore Purchases."
Make sure you're signed into the same Apple ID you used to subscribe.
Check that your subscription is active: Settings → your name → Subscriptions → GameHaven.
Restart the app after restoring.

T3. My progress or stats aren't syncing across devices.
Make sure you're signed in with the same Apple ID on both devices.
Go to Profile → tap the cloud sync button to force a manual sync.
Ensure both devices have an internet connection.
Progress only syncs if you signed in with Apple before playing. Data created while signed out stays local until you sign in.
T4. Daily puzzle limits aren't resetting.
Daily limits (Word Search and Crossword) reset at midnight local time.
Force-close and reopen the app after midnight if the limits haven't refreshed.

T5. I can't connect to online multiplayer or tournaments.
Check your internet connection (Wi-Fi or cellular).
Make sure you're signed in with Apple (required for online features).
Ensure you have an active Premium subscription.
If matchmaking is slow, other players may not be available at that time. Try again later.
Restart the app and try again.
T6. I deleted the app. Is my data gone?
If you were signed in with Apple before deleting the app, your data is saved in the cloud. Reinstall GameHaven, sign in with the same Apple ID, and your progress will sync automatically.
If you were NOT signed in, local data is lost when the app is deleted.
T7. I was charged but didn't receive Premium.
This is usually a temporary delay. Wait a few minutes and reopen the app.
Go to Profile → Premium → "Restore Purchases."
If the charge appears on your Apple receipt but Premium isn't active after restoring, contact us at gamehavenappsupport@gmail.com with a screenshot of your receipt.
T8. The app is running slowly or using too much battery.
Make sure you're on the latest version of GameHaven.
Close other apps running in the background.
Restart your device.
GameHaven is optimized for battery efficiency, but extended online multiplayer sessions may use more power.
T9. I can't sign in with Apple.
Ensure you're running iOS 13 or later (iOS 18+ recommended).
Go to device Settings → your name → Sign-In & Security and make sure Sign in with Apple is enabled.
Check your internet connection.
Restart the app and try again.
T10. I accidentally deleted my account. Can I recover it?
Account deletion is permanent and cannot be undone. All data — including stats, match history, friends, and saved progress — is permanently removed.
You can create a new account by signing in with Apple again, but your previous data cannot be restored.
T11. Coins aren't appearing after a game.
Coins are awarded at the end of each completed game. Make sure you finished the game (didn't quit early).
If you're a Premium subscriber, verify your subscription is active — 2x coin earnings only apply while Premium is active.
Force-close and reopen the app. Your coin balance should update.

T12. AI-generated content isn't loading (Trivia questions, puzzles).
AI-generated content requires an internet connection.
This feature is available to Premium subscribers only. Free users receive content from the base pool.
If you're Premium and connected to the internet but content isn't loading, restart the app and try again.

Actual prices may vary by region and currency. The price confirmed at the time of purchase on the App Store applies. Prices are displayed in your local currency on the subscription purchase screen.
Free Trial
We may offer a free trial period for new subscribers. If a free trial is offered, the specific duration will be displayed on the subscription purchase screen. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the plan price displayed at sign-up. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Only one free trial is available per Apple ID.
Payment & Renewal
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. Subscription prices may change; you will be notified in advance of any price increase and must agree to the new price to continue.
What Free Users Get
Free users have access to all single-player games with the following content limits:
• 200 trivia questions from the base pool

Managing Your Subscription
You can manage or cancel your subscription at any time through any of the following methods:
• On your device: Settings → [Your Name] → Subscriptions
• In the App Store app: tap your profile → Subscriptions
• Online: apps.apple.com/account/subscriptions
• In GameHaven: Profile → tap "Manage" next to your Premium status
Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then. No partial refunds are provided for unused portions of a subscription period.
Restoring Purchases
If you reinstall GameHaven or switch devices, you can restore your active subscription by going to Profile → tap the Premium section → tap "Restore Purchases" on the subscription screen. This verifies your subscription status with Apple and reactivates your premium access at no additional charge.
Refunds
All purchases are processed by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support directly. GameHaven does not process payments or issue refunds directly.

ACCOUNT DELETION
How to Delete Your Account
You can permanently delete your GameHaven account at any time by following these steps:
1. Open GameHaven
2. Go to Profile (tap the person icon in the bottom tab bar)
3. Scroll down to the Account section
4. Tap "Delete Account"
5. Confirm the deletion when prompted
What Happens When You Delete Your Account
When you delete your account, ALL of the following data is permanently and immediately removed from our servers:
• Your profile information (display name, avatar, friend code)
• All game statistics and records
• All match history (single-player and multiplayer)
• All friend connections and pending friend requests
• All saved game progress
• All tournament participation records
• All subscription and purchase history records
• All user progress and achievement data
• All cloud-synced data
This action is IRREVERSIBLE. Once your account is deleted, your data cannot be recovered.
What Is NOT Affected by Account Deletion
• Your Apple ID subscription: Deleting your GameHaven account does NOT automatically cancel your Apple subscription. If you have an active GameHaven Premium subscription, you must cancel it separately to avoid future charges.
• Data stored locally on your device: Uninstalling the app removes all locally stored data.
How to Cancel Your Subscription Before or After Deleting Your Account
To cancel your subscription and stop future charges:
• On your device: Settings → [Your Name] → Subscriptions → GameHaven Premium → Cancel Subscription
• In the App Store app: tap your profile → Subscriptions → GameHaven Premium → Cancel Subscription
• Online: apps.apple.com/account/subscriptions
Important: Even after account deletion, Apple may retain transaction records subject to Apple's Privacy Policy and applicable tax/accounting laws.
Guest Users
If you are using GameHaven as a guest (without signing in with Apple), deleting the app removes all locally stored data. There is no cloud data to delete since guest data is stored only on your device.
Data Retention
• Local data is retained on your device for as long as the app is installed.
• Cloud data is retained for as long as you maintain an active account.
• When you delete your account, all cloud data is permanently and immediately removed.
• Subscription and purchase records may be retained by Apple as required by applicable tax and accounting law (typically 3–7 years). GameHaven does not retain this data after account deletion.
Children's Accounts
Account deletion for children's accounts may be initiated by a parent or guardian. The same deletion process applies, and all data is permanently removed. Parents and guardians should ensure any active subscriptions are cancelled separately through Apple.

3. Data Storage & Processing
Your game data is stored locally on your device by default. If you sign in with Apple and enable cloud sync, your data is transmitted to and stored on servers provided by Supabase, Inc., our cloud infrastructure provider. Supabase processes data on our behalf and is contractually obligated to protect your information.
Data may be stored on servers located in the United States. By using cloud sync, you consent to the transfer of your data to the United States. We rely on Supabase's data processing agreement and industry-standard security measures (including encryption in transit and at rest) to ensure adequate protection of your data during international transfers.
4. Third-Party Services
Apple (App Store, StoreKit & Sign In)
We use Apple's Sign in with Apple for optional authentication. Apple provides us only the information you authorize (name, email). All in-app purchases and subscriptions are processed entirely by Apple through StoreKit and the App Store. Apple collects payment and transaction data subject to Apple's Privacy Policy (apple.com/privacy). We do not have access to your payment method details. We do NOT use any third-party payment processors, analytics SDKs, or advertising SDKs.
Supabase (Cloud Infrastructure)
When cloud sync is enabled, your profile, game stats, match history, subscription status, and saved games are stored using Supabase. See Supabase's privacy policy at supabase.com/privacy.
MultipeerConnectivity
Local multiplayer uses Apple's MultipeerConnectivity framework to discover nearby players on the same Wi-Fi network. Device names and game data are shared only during active sessions and are not persisted by other devices.
5. Data Sharing & Sale
We do NOT sell, rent, trade, or share your personal information with third parties for advertising, marketing, or any commercial purpose. We do not integrate any third-party analytics, advertising, tracking, or attribution SDKs. We do not participate in data broker arrangements. Your data is shared only with the service providers described above (Apple and Supabase), solely to operate the app and provide the services you have requested.
6. Tracking & App Tracking Transparency
GameHaven does NOT track you across other companies' apps or websites. We do not use the Advertising Identifier (IDFA), and we do not participate in any cross-app tracking, retargeting, or targeted advertising programs. We fully comply with Apple's App Tracking Transparency (ATT) framework — we will never request tracking permission because we do not track. Our App Store Privacy Nutrition Label accurately reflects that we collect no data used to track you.
7. Children's Privacy (COPPA Compliance)
GameHaven is designed to be family-friendly and suitable for all ages. We comply with the Children's Online Privacy Protection Act (COPPA), the EU's General Data Protection Regulation as it applies to children (GDPR Article 8), and applicable international children's privacy laws.
We do not knowingly collect personal information from children under 13 (or the applicable age of digital consent in your jurisdiction) without verifiable parental consent. Certain features including account creation, profile editing, cloud sync, and account deletion are protected by a parental gate requiring a simple math verification.
The app does not contain any advertising, does not link to social media, and does not enable unrestricted communication between users. All in-app purchases are processed through Apple's parental controls system (Ask to Buy).
If you are a parent or guardian and believe your child has provided personal information without your consent, please contact us at the email below. We will promptly investigate and delete any such information from our servers within 48 hours of verification.

Access: View all your personal data through your Profile at any time
Correction: Modify your display name and avatar at any time

Portability: Your game data is visible in your Profile and stored locally on your device

9. California Residents (CCPA/CPRA)
If you are a California resident, you have the right under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) to:

To exercise these rights, use the in-app deletion feature or contact us at the email below. We will respond to verifiable consumer requests within 45 days. We will not charge a fee for processing your request unless it is manifestly unfounded or excessive.
10. European Residents (GDPR)
If you are located in the European Economic Area (EEA) or the United Kingdom, the General Data Protection Regulation (GDPR) and UK GDPR apply. Our legal bases for processing your data are:
Consent — when you sign in and enable cloud sync
Performance of a contract — to provide the game services and manage your subscription
Legitimate interest — to improve the app and prevent abuse
You have the right to access, rectify, erase, restrict processing, object to processing, and port your data. You may withdraw consent at any time without affecting the lawfulness of processing based on consent before withdrawal. You may also lodge a complaint with your local supervisory authority (e.g. the ICO in the UK, CNIL in France). For data transfers outside the EEA, we rely on our service providers' Standard Contractual Clauses (SCCs) and data processing agreements.
11. Data Retention
Local data is retained on your device for as long as the app is installed. Cloud data is retained for as long as you maintain an active account. Subscription and purchase records are retained as long as required by applicable tax and accounting law (typically 3–7 years).
When you delete your account, all cloud data — including your profile, game stats, match history, subscription records, and saved games — is permanently and immediately removed from our servers. This action is irreversible. Uninstalling the app removes all locally stored data from your device.
12. Security
We implement industry-standard security measures to protect your data, including encrypted data transmission (TLS 1.2+), secure authentication via Apple Sign In with token-based session management, row-level security (RLS) on our cloud database ensuring users can only access their own data, and access controls on our cloud infrastructure. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.
13. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last updated" date below and, where required by law, through in-app notification. Continued use of GameHaven after changes are posted constitutes acceptance of the updated policy. We encourage you to review this policy periodically. If we make material changes that affect the processing of children's data, we will take additional steps to notify parents and guardians.

1. End-User License Agreement (EULA)
This End-User License Agreement ("EULA") is a legal agreement between you and GameHaven ("we", "us", "our") for the use of the GameHaven mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA and these Terms of Service. If you do not agree to these terms, do not download, install, or use the App.
This EULA is entered into between you and GameHaven only, and not with Apple Inc. ("Apple"). GameHaven, not Apple, is solely responsible for the App and its content. This EULA must comply with the Apple Media Services Terms and Conditions. In the event of any conflict between this EULA and Apple's terms, Apple's terms shall prevail.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, strictly in accordance with this EULA and the Apple Media Services Terms and Conditions. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.
3. Restrictions
You may not copy, modify, or create derivative works of the App
You may not reverse engineer, decompile, or disassemble the App
You may not rent, lease, lend, sell, or sublicense the App
You may not exploit bugs, cheats, or vulnerabilities in the App
You may not use the App for any unlawful or unauthorized purpose
You may not use automated systems or bots to interact with the App
You may not circumvent or attempt to circumvent content limits, paywalls, or premium feature restrictions
4. Auto-Renewable Subscriptions
GameHaven offers optional auto-renewable subscription plans that unlock premium features. By subscribing, you agree to the following terms:

Free Tier
Free users have access to all single-player games with content limits: 200 trivia questions, 100 Rocket Blast Off words, 5 word search puzzles per day, and 5 crossword puzzles per day. Multiplayer, tournaments, the shop, and advanced stats require a premium subscription.
Billing & Renewal
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan. Subscription prices may change; you will be notified in advance of any price increase and must agree to the new price to continue.
Free Trial
We may offer a free trial period for new subscribers. If a free trial is offered, the specific duration will be displayed on the subscription purchase screen. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the plan price displayed at sign-up. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Only one free trial is available per Apple ID.
Managing & Cancelling Subscriptions
You can manage or cancel your subscription at any time through your device's Settings > [Your Name] > Subscriptions, through the App Store app, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until then. No partial refunds are provided for unused portions of a subscription period.
Restore Purchases
If you reinstall the App or switch devices, you can restore your active subscription by tapping "Restore Purchases" on the subscription screen. This verifies your subscription status with Apple and reactivates your premium access at no additional charge.
Refunds
All purchases are processed by Apple. Refund requests must be submitted through Apple's support at reportaproblem.apple.com. We do not process refunds directly. Apple's refund policies apply to all transactions.
5. Acceptable Use
GameHaven is provided for personal, non-commercial entertainment
You must not use the App to harass, bully, or harm other players
You are responsible for maintaining the security of your account
Display names must be appropriate, family-friendly, and inoffensive
6. Multiplayer Conduct
Treat all players with respect and good sportsmanship
Do not intentionally disconnect to avoid losses
Do not use external tools to gain unfair advantages
Offensive, discriminatory, or inappropriate behavior is prohibited
We reserve the right to suspend or terminate accounts that violate multiplayer conduct standards without prior notice or refund.
7. User Content
You are solely responsible for your display name and any content you create within the App. We reserve the right to remove or modify content that violates our community standards without prior notice. The App includes automated content filtering, but we do not guarantee that all inappropriate content will be caught.
8. Account & Data
You may use GameHaven as a guest or sign in with Apple
Guest accounts store data locally on your device only
Signed-in accounts may sync data to our cloud servers via Supabase
You can delete your account and all associated data at any time from your Profile
Account deletion is permanent and irreversible — all cloud data will be immediately removed from our servers
We are not responsible for data loss caused by device failure or app removal
Subscription status is synced to the cloud for cross-device access when signed in
9. Age Requirement
GameHaven is intended for users of all ages. By using this App, you confirm that you meet the minimum age requirement set by Apple for your region, or that a parent or legal guardian has reviewed and consented to these terms on your behalf. Certain features are protected by a parental gate. Parents and guardians are responsible for monitoring their children's use of the App, including any in-app purchases made through the child's device. All in-app purchases respect Apple's Ask to Buy parental controls.
10. Intellectual Property
All content, graphics, game mechanics, sounds, AI-generated content, and design elements in GameHaven are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without prior written permission. AI-generated content (trivia questions, words, puzzles) is provided for personal use within the App only.
11. Third-Party Services
The App uses Apple's Sign in with Apple, Apple's App Store and StoreKit for payment processing and subscription management, Apple's MultipeerConnectivity framework, and Supabase cloud services. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or outages of third-party services. No third-party advertising, analytics, or tracking SDKs are used.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED FOR ENTERTAINMENT PURPOSES AND MAY CONTAIN INACCURACIES.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMEHAVEN OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless GameHaven and its developers from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App, your violation of these terms, or your violation of any rights of another.
15. Termination
We reserve the right to suspend or terminate your access to GameHaven at any time, with or without cause, for violations of these terms or any other reason. Upon termination, your license to use the App is immediately revoked. You may stop using the App at any time by uninstalling it from your device and deleting your account. Termination does not entitle you to a refund of any subscription fees already paid. Active subscriptions must be cancelled separately through Apple.
16. Apple-Specific Terms (Required)
You acknowledge and agree to the following with respect to Apple Inc. ("Apple"):
This EULA is between you and GameHaven only, not Apple. GameHaven, not Apple, is solely responsible for the App and its content
The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions
Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, GameHaven, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim
Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties
17. Dispute Resolution
Any dispute arising out of or relating to these terms or the App shall first be attempted to be resolved through good-faith negotiation by contacting us at the email below. If the dispute cannot be resolved informally within thirty (30) days, it shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You agree to waive any right to participate in a class-action lawsuit or class-wide arbitration. Nothing in this section prevents you from bringing issues to the attention of federal, state, or local agencies, who may seek relief against us on your behalf. EU and UK residents retain the right to bring claims in their local courts as required by applicable consumer protection law.
18. Governing Law
These Terms of Service and EULA are governed by and construed in accordance with the laws of the United States and the state in which we operate, without regard to conflict of law principles. If any provision of these terms conflicts with Apple's standard EULA or the Apple Media Services Terms and Conditions, Apple's terms shall prevail to the extent required. EU and UK residents may also benefit from mandatory consumer protection provisions of their country of residence.
19. Severability
If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect and enforceable.
20. Entire Agreement
These Terms of Service, together with the Privacy Policy and any subscription terms presented at the time of purchase, constitute the entire agreement between you and GameHaven regarding the use of the App, and supersede all prior agreements, understandings, and communications, whether written or oral.
21. Changes to Terms
We may update these Terms of Service periodically. We will notify you of material changes by updating the "Last updated" date below. Continued use of GameHaven after changes are posted constitutes acceptance of the revised terms. If you do not agree to the revised terms, you must stop using the App and cancel any active subscriptions.
